These Terms of Service ("Terms") are a legal agreement between you and MINOVA Collections LLC ("CubWallet," "we," "us," or "our") governing your use of the CubWallet mobile application and website (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and able to form a binding contract to create an account. CubWallet is intended to be set up and controlled by a parent or legal guardian, who creates and manages profiles for their children. You are responsible for all activity under your account and for supervising any child profile you create. You agree to provide accurate information and to keep your login credentials secure.
CubWallet is an educational money-management and chore-tracking tool for families. It helps kids learn to earn, save, give, and budget using virtual jars and pretend or family-tracked amounts.
CubWallet is not a bank, credit union, broker-dealer, investment adviser, money transmitter, or financial institution. It does not hold, store, transfer, or invest real money, and it is not FDIC-insured. Any "invest," "savings," "jar," balance, or portfolio feature is an educational tracker that displays figures entered by a parent โ for example, the price of a share a parent chose to buy in their own separate brokerage account. CubWallet does not execute trades or connect to any market.
Nothing in the Service is financial, investment, tax, or legal advice, or a recommendation to buy or sell any security or product. Any real-world money, purchase, or investment decision you or your family make is your own.
You may create child profiles for members of your household. You represent that you are the parent or legal guardian of each child whose information you enter, and that you consent to our collection and use of that information as described in our Privacy Policy. You are responsible for the accuracy of information you enter and for how the Service is used within your family.
CubWallet offers free features and optional paid features, including auto-renewing subscriptions and one-time in-app purchases (for example, add-on feature bundles). All payments are processed by Apple through your Apple ID and are subject to Apple's terms.
You agree not to: use the Service for any unlawful purpose; attempt to access accounts or data that are not yours; reverse engineer, decompile, or interfere with the Service; upload malicious code; scrape or harvest data; or use the Service in a way that harms CubWallet, other users, or any child. We may suspend or terminate accounts that violate these Terms.
You retain ownership of the information you enter (names, chores, goals, amounts, etc.). You grant us a limited license to store, process, and display that information solely to operate and improve the Service. You are responsible for the content you enter and confirm you have the right to enter it.
The Service, including its software, design, text, graphics, and logos, is owned by CubWallet and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your family's personal, non-commercial use. All rights not expressly granted are reserved.
The Service relies on third parties, including Apple (distribution and billing) and our hosting and infrastructure providers. Your use of those services may be subject to their terms, and we are not responsible for third-party services.
To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any figure, calculation, balance, or sync will be accurate or preserved.
To the fullest extent permitted by law, in no event will CubWallet, its owners, officers, employees, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or savings, or for amounts spent or lost based on figures shown in the Service, arising out of or relating to your use of (or inability to use) the Service โ even if advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Service will not exceed the greater of (a) the total amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) US $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless CubWallet and its owners, officers, employees, contractors, and suppliers from and against any claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use or misuse of the Service; (b) your violation of these Terms or any law; (c) your violation of any third party's rights; (d) any content or figures you enter; (e) any real-world financial, purchase, or investment decision you or your family make, including any security tracked in the Service; and (f) your supervision (or lack of supervision) of any child user under your account.
These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-laws rules. Before filing any claim, you agree to contact us at cubwalletapp@gmail.com and attempt to resolve the dispute informally for at least 30 days. Except where prohibited, the state and federal courts located in Cook County, Illinois will have exclusive jurisdiction and venue, and you consent to personal jurisdiction there.
We may modify the Service or these Terms at any time. If we make material changes, we will update the "Last updated" date and, where appropriate, provide notice. Your continued use after changes take effect means you accept the revised Terms.
You may stop using the Service and delete your account at any time (see our Data Deletion page). We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.
